Children's Wellbeing and Schools Act

The Children's Wellbeing and Schools Act has received Royal Assent, introducing significant new duties and measures with implications for child protection, fostering, and kinship care practice and policy. This briefing is for Coram BAAF members working in fostering, and kinship care, and will also be of interest to  legal professionals, health professionals, researchers  and those impacted by the changes. It will clarify some of the new duties, implementation timescales, and actions your service may need to take or consider.

WHAT YOU'LL LEARN

Key provisions include:

  • a new requirement for local authorities to publish a local kinship offer
  • a duty to offer family group decision-making meetings to parents  at pre-proceedings stage
  • imposing a specific duty on local authorities to prioritise and promote sibling relationships for children in care
  • new duties intended to strengthen the support available to young people as they leave care
  • new powers for the Secretary of State to be able to limit profits of specified non-local authority Ofsted-registered providers of children’s homes and fostering agencies
  • a provider oversight regime to help safeguard and protect vulnerable children
  • new corporate parenting responsibilities on relevant authorities
  • new powers for the Secretary of State to direct local authorities to establish regional co-operation arrangements.
